It is these laws have drawn particular attention during the Senators held on the eve of talk with correspondent of «People’s speech».
- Overturn of the death penalty is one of the most pressing issues in any country seeking to build a legal state and civil society based on democratic principles - said a member of the Senate Committee on Science, Education, Culture and Sport Shavkat Avezov. - From the first years of independence, give more emphasis to the rights and freedoms of citizens, first of all its inalienable rights to life, health. These rights are enshrined in our Constitution and is guaranteed to each citizen of the country. They are reflected in the criminal law. If you remember, even according to the canons of our holy religion, the wealth which granted to the man by numen, can not be taken away by another man. I mean the main domain such as life, and this includes health, peace and tranquility.
- The right to life is our highest value. There shall be no violation of the law even against the man who should be punished for his offense - continued a member of the Senate Committee on Budget and economic reforms Marhabad Baltabaeva. - Based on the purely humanitarian considerations was adopted Decree of the President to abolish the death penalty. At the plenary session of Senate of Oliy Majlis, we will discuss changes in legislation in relation to the abolition of the death penalty. These changes have affected, particular in the Criminal Code of Uzbekistan. The Code is complemented by a separate new section, which sets out the procedure and conditions for the execution of sentences of life imprisonment. In the appendices are also the norm of living space per convict, his right to receive monthly food, parcels and packages, the number of allowed visits and phone calls from relatives. Sentenced to life imprisonment given the opportunity to embark on a path correction and return to a free life, filed an application for clemency.
Said member of the Senate Committee on Budget and Economic Reforms Nikolay Kuchersky:
- The most important task is national legal and judicial reform and to expand the powers of the court for effective protection of individual rights at the pre-trial stage. That was the main target to transfer of the prosecution of the courts to issue sanctions on detention. In contrast to the existing current order authorizing detention of the proposed changes provide for additional guarantees for the rights of the accused. In particular, he may appeal the determination of the court for detention in a higher court. This means the direct application to the court to restore their legitimate rights and protection from prosecution at the stage of preliminary investigation. Thus, this law allows to deepen the liberalization of the criminal procedure law, strengthen the independence of the judiciary. Made to the CCP changes and additions make it possible to bring its rules into line with international documents signed by Uzbekistan, such as the Universal Declaration of Human Rights, the International Covenant on Civil and Political Rights.
